Can I invest through a company, family trust or SMSF?
Generally yes, and each structure has different eligibility, tax and compliance consequences.
- Company - profits taxed at the company rate; franking flows through on distribution; no CGT discount
- Family trust - income distributed to beneficiaries and taxed in their hands; the trust deed governs what it can hold
- SMSF - concessional tax treatment, but bound by the trust deed, the investment strategy requirement and the sole-purpose test
Note that an entity may reach the wholesale threshold when an individual would not, which changes the disclosure you receive.
